    Проблеми забезпечення балансу між митним контролем та спрощенням процедур міжнародної торгівлі

    У статті досліджено проблеми забезпечення балансу між митним контролем та спрощенням процедур міжнародної торгівлі. Доведено, що успіх реалізації заходів щодо сприяння міжнародній торгівлі в значній мірі залежить від можливості досягнення належного балансу між регуляторним контролем і спрощенням митних процедур. Проаналізовано рекомендації щодо забезпечення безпеки та спрощення процедур міжнародної торгівлі відповідно до положень Кіотської конвенції, Рамкових стандартів ВМО, а також Угоди СОТ про спрощення світової торгівлі. Узагальнено основні новації проекту Закону України «Про внесення змін до МКУ (щодо УЕО та спрощення митних формальностей)». The article is devoted to study foreign experience to balance between customs controls and facilitation of international trade for its adaptation to the national practice of customs regulations. The problem of providing a balance between customs controls and facilitation of international trade was investigated in the article. The authors emphasized that the success of the implementation of measures to promote international trade largely depends on the possibility of achieving a proper balance between regulatory control and simplification of customs procedures in the field of foreign trade. Recommendations for security and facilitation of international trade under the provisions of the Kyoto Convention, the WCO Framework of Standards and the WTO Agreement on the facilitation of global trade were analyzed. In addition, the main innovations of the draft Law of Ukraine "On Amendments to the ICU (on UEO and simplification of customs formalities were consolidated. One of the conditions for successful implementation of measures to restore the economic potential of Ukraine is to create favorable conditions in foreign economic activities to enhance national economic competitiveness internationally.

    Ґенеза категорії «митна процедура» в законодавчому та науковому контекстах

    В статті проаналізовано етимологію категорій «процедура», «режим», «митна процедура» та «митний режим» та зв’язок між ними. Авторами запропоновано два підходи до тлумачення категорії «митна процедура»: законодавчий та науковий. В статті здійснено порівняльну характеристику митної термінології відповідно вітчизняного та зарубіжного законодавства. Запропоновано внести зміни до Митного кодексу України з метою узгодження категорії «митна процедура» з міжнародними нормами. The purpose of the article – the study of etymology categories of «procedure», «regime», «customs procedure», «customs regime» and identifying the relationship between them in both domestic and foreign laws. This paper analyzes the etymology of the categories of «procedure», «regime», «customs procedure» and «customs regime» and the relationship between them. The authors proposed two approaches to the interpretation of the category of «customs procedure»: legal and scientific. In the article the comparative characteristics of customs terms under domestic and international law. Proposed to amend the Customs Code of Ukraine to harmonize the category of «customs procedure» with international standards.

    Досвід впровадження системи контролю імпорту та експорту (ІCS/ECS) в ЄС

    У статті досліджено європейський досвід впровадження системи контролю імпорту (ІCS) та системи контролю експорту (ECS) ЄС відповідно до Рамкових стандартів ВМО. Узагальнено нормативно-правове забезпечення імплементації системи ICS/ECS. Проаналізовано порядок подання спрощеної ввізної декларації, вимоги до змісту та обсягу інформації, визначено терміни її надсилання з урахуванням специфіки виду транспорту, а також наведено перелік товарів, за якими її не потрібно подавати. The purpose of this writing is to study the European experience of introduction of prior notification by developing and implementing a monitoring system of import and export (ICS/ECS) under the Framework security standards and facilitate international trade WMO. In the article the European experience implementing the import control system (ICS) and the export control system (ECS) of EU under the Framework WMO standards. Overview Legal provisions for the implementation of the ICS / ECS. Simplified analysis procedure for filing the import declaration requirements to the content and volume of information defined terms sending it to the specific type of transport, as well as provides a list of goods for which it is not required to file. The results are aimed at ensuring the further development of the use of risk management in Ukraine by improving its information security in order to simultaneously simplify customs procedures and ensure an appropriate level of security of the state, business and society.
